Legislative &
Regulatory Objectives

Restrict sole
source procurements that are claimed to be based on compatibility
with legacy systems or on requirements that stipulate solutions that
only a single vendor can supply.

Obtain funding
to enable transit agencies to eliminate reliance on proprietary legacy
systems. (This would include, for example, funding to purchase intellectual
property rights, or to replace equipment if rights are not available,
etc.).

Provide for use
of open architecture in connection with transit-related information
systems and automated fare collection procurements.

Emphasize that
procurement specifications must be based on open industry standards
and not on proprietary solutions.

Develop effective
means for ensuring that procurements do not include specifications
that are unnecessarily restrictive and thus limit the field of potential
suppliers.

Support reasonable
Buy America requirements that encourage investment in U.S. manufacturing
facilities but do not restrict companies ability to produce
technologically advanced, cost-effective products that can compete
in the world market.
